Motions to Reopen

If you have received an order of deportation, don't panic. The order does not mean that you need to leave the country immediately.


You may be able to have your case reopened in case you were removed in-absentia ( not showing up in court). Some reasons for reopening your case are as follows:


  • You were not aware of your court date or your attorney did not inform you of the day
  • In case of emergencies, such as illnesses and major accidents, which makes it difficult for you to present yourself in court on the specific date, you can request to have your case reopened


However, make sure you contact our office once you have received a deportation order, so our attorney can determine the best way to have your case reopened.

Parole and Bond Requests

How to apply for release from detention? This can be done by a Parole Request made through ICE or by a Motion for a Bond Redetermination Hearing through the Immigration Court.


Detention release via Parole Requests

How this process works is as follows. Once you have been detained, ICE will determine whether to release you on your word or ask you to pay a certain sum of money for release. In some cases, they may also require additional information showing that you are eligible for detention release. Once the information has been filed, ICE will take a decision on your release.

Bond Redetermination Hearing through the Immigration Court

This is the course to pursue if ICE does not release you and your case goes before the immigration Judge. In this situation, you have the right to ask the Judge for a bond for being released from detention.


However, not all people may be eligible for this. Some may be detained mandatorily.

Family-Based Immigration

Other than the Immigration Court, there are other ways to gain residence and citizenship status in the United States. This includes the "family-based immigration process".


If you have a qualifying relative in the US, you may be able to gain residence status without having to go to the Immigration Court. For this, your qualifying relative needs to submit an I-130 Petition. Based on various factors, you may have to either "manage" your status during your stay in the US or file a "waiver", which will enable you to complete most of the immigration process inside the US.
